Maternity Mum Terms and Conditions

1. "The Contract" Maternity Mum Terms and Conditions of business

Shall represent a legally binding contract between anyone wishing to employ a maternity nurse through our agency (the "Client") and Maternity Mum (the "Agency") henceforth known as "Client "and "Agency", additional "Maternity Nurse" meaning any suitable candidate that we may introduce to the Client and "Agency Fees" meaning the agency introduction fee that is payable to the Agency for introducing a maternity nurse to the Client.

2. Acceptance of our Terms and Conditions

The verbal/written/electronically ( email or text) instruction by the Client to the Agency to submit suitable maternity nurses for contact or interview or arrangement of interviews shall constitute acceptance by the Client of these terms and conditions.

3. Responsibilities

a. The Client will be responsible for taking up references and obtaining confirmation of qualification, and be satisfied that the maternity nurse is suitable for their requirements.

b. The Agency shall not be liable to the Client for any loss, liability, damage, costs, claims or expenses suffered or incurred by the Client arising from or connected with the recruitment or engagement of any candidate by the Client howsoever arising.

c. The Client agrees to notify the Agency either verbally, electronically (text or email) or in writing as soon as an offer of employment has been made to any maternity nurse.

d. The Agency acts only as a staff placement agency and does not directly or indirectly employ the maternity nurses.

4. Fees

a. Our agency fees for UK placements are as follows: £20.00 per day (minimum fee of £100.00) The fee applies to all maternity nurses, 24hrs, day or night maternity nurses.

b. Our agency fees for overseas placements are as follows: £25.00 per day (minimum fee of £100.00) The fee applies to all maternity nurses, 24hrs, days or nights.

c. If the Client extends the contract over 26 weeks, permanent placement fees apply. Clients are charged 6 x the weekly net wage.

d. Returning clients requesting to re- book the same maternity nurse, if availability allows, qualify for the following discount; UK placements £10 per night (minimum fee of £100). Overseas placements £15.00 per day (minimum fee of £100.00 ).

e. Returning clients who are unable to secure the same maternity nurse are entitled to receive 10% discount,

providing it is for the same family.

5. Payment

a. All agency introduction fees are to be paid in full once the booking is secured and prior to the placement commencing.

b. Payment is to be made in pounds sterling by either bank transfer, cheque or cash. Payment is due within 7 days of the date of the invoice, or before the booking commences, whichever is sooner.

c. The Agency reserve the right to charge 5% per week on any overdue invoices exceeding 21 days of the date of the invoice.

d. The Agency reserve the right to charge the Client legal, travel and any other costs incurred for recovering our agency introduction fees.

e. Payments to the maternity nurse is to be made in pounds sterling by either bank transfer, cheque or cash.

6. Cancellation Policy

a. Our agency fees are non refundable except in exceptional circumstances and at the discretion of the Agency

b. If the Client cancels the booking before the commencement of the contract the Agency reserves the right to keep the agency fees (for work already undertaken)

c. If the Client cancels prior to the start of the contract all deposits made to the maternity nurse are non refundable. (refer to individual maternity nurse contract)ddd. If d.the Client chooses to terminate the contract early, 50% of the remaining contract will be paid directly to the maternity nurse (for loss of income). No agency fees will be refunded except if it us due to gross misconduct by the maternity nurse

e. If the maternity nurse cancels prior to commencement of the booking please inform the agency asap. We will find you a replacement maternity nurse (no cost involved). In the unlikely event that we are unable to find you a suitable alternative maternity nurse, all agency fees will be refunded in full. A refund will only be given if all fees have been paid in full and adhere to our payment terms and conditions (5b) and no breach of confidentiality has occurred (7c).

f. If the maternity nurse cancels prior to the start of the booking then any deposits paid directly to the maternity nurse will be fully refunded to the client by the maternity nurse (refer to the individual maternity nurse contract for deposits paid).

g. If the maternity nurse has to cancel the contract early due to reasons beyond both the agency and maternity nurses control i.e. sudden illness. The agency will supply an alternative maternity nurse (no cost involved). In the unlikely event that we are unable to find a suitable replacement, the agency fee will be refunded on a pro rota basis. If the maternity nurse terminates the contract early due to unreasonable behaviour by the Client/family or a breach of contract by the Client then no replacement or reimbursement of agency fees will apply.

7. Confidentiality

a. All information supplied by the Agency to the Client is strictly confidential. If the Client passes on the details of a maternity nurse to a third party who subsequently engages the maternity nurses services, the Client will remain liable for the full agency introduction fee. (4)

b. If the Client fails to inform the agency that a contract between the client and maternity nurse exists following the introduction of the maternity nurse from the Agency, the full agency introduction fee will apply (4).

c. In the event of any breach of confidentiality, the agency introduction fee cancellation policy will not apply and no replacement or refund will be given (6e).

8. Extension of Booking

In the event that the Client wishes to extend the booking, the Client must inform the Agency. A new invoice will be issued for the extended days/weeks. Payment terms and conditions apply (5b)

9. Maternity Nurse Terms and Conditions

a. The Client will be responsible to sign a contract directly with the maternity nurse.

b. The Client will be responsible to pay a non refundable deposit to the maternity nurse to secure the booking.

c.  If the Client cancels prior to the start of the contract all deposits made to the maternity nurse are non refundable.

d. If the Client chooses to terminate the contract early, 50% of the remaining contract will be paid directly to the maternity nurse (except for gross misconduct by the maternity nurse).

e. The Client is liable to pay the maternity nurse a retainer of 50% salary from the date of the start date of the contract, should the booking be delayed.

f. For overseas bookings the Client is responsible to pay for all travel expenses, including flights, transfers and visas prior to leaving the UK.

g. The Client is to arrange travel expenses/ food expenses/ break times/ days off/any additional duties directly with the maternity nurse.

h. If the maternity nurse cancels prior to the start of the booking then any deposits paid directly to the maternity nurse will be fully refunded to the client by the maternity nurse.

I. Payment is to be made in pounds sterling by either bank transfer, cheque or cash, to be paid directly to the maternity nurse weekly.

j. Please note all maternity nurses are self employed and are responsible for their own tax and national insurance.
